Terms & Conditions
Prices: We reserve the right to change prices. The prices of paper may increase during the life of this catalogue. Raw materials may fluctuate due to currency changes always confirm prices with your representative.
VAT: All prices quoted are exclusive of VAT. This will be levied at the appropriate rate on the invoice tax date.
Payment: Except where otherwise agreed in writing, payment for goods supplied is due, without deduction 30 days from the date of invoice.We reserve the right to charge interest on all overdue accounts at 4% above the Bank of England base rate on the outstanding balance. The Customer shall be liable for any legal costs incurred by the Company in collecting, or attempting to collect, any overdue payment, whether or not recovery proceedings are commenced.
Ownership:Title of the goods supplied will remain the property of Frank Berry (Office Supplies) Ltd, trading as Frank Berry Otter, until payment has been made in full.
Stock:Every effort will be made to supply orders in their entirety. However, if any item is out of stock, the delivery note will show the missing item, and the balance will be despatched as soon as possible thereafter. We reserve the right to supply alternative products of a comparable quality to those shown if necessary.
Claims & Returns:Claims for shortages, or faulty or damaged goods must be notified to Frank Berry (Office Supplies) Ltd in writing within 3 days of receipt of goods. Goods supplied correctly to order are not returnable except by previous arrangement with the Company which may incur a carriage and handling cost. This does not affect your statutory rights.
Cancelled orders must be put in writing. if written evidence is not provided as proof of cancellation the order will still be deemed as valid and no credit or refund will be given.
Proper Law: Contracts shall be governed by and construed in accordance with English Law and both parties consent to the non-exclusive jurisdiction of the English courts.
Minimum Order: There is a £30 minimum order value to prevent inefficient handling and unnecessary delivery costs. Orders below this value may incur a £5.00 handling charge in addition to any delivery charge.
Carriage & Packing: Educational establishments covered by Local Authority contracts should refer to the terms and conditions applicable to those contracts. Otherwise the following terms apply:
* Orders between £30.00 and £50.00, Charge: £7.50
* Orders over £50.00, No Charge.
Returns: Please note for all returns we have to be notified with in 3 working days of delviery in writing to sales@frankberry.co.uk
Personalisation: Blocks are the property of the customer, held in trust by Otter. Customers are reminded that the blocks have a limited life, and it is the customer’s responsibility to replace them when the quality is no longer acceptable. E. & O.E.
